Welcome to Three Palms Rental Management. These Terms of Service (“Terms”) govern your access to and use of the website located at https://threepalmsrentalmanagement.com/ (the “Site”) and any services offered by Three Palms Rental Management (the “Services”). When you access or use our Site or Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our Site or Services.
We provide rental property management services for property owners, including marketing properties, screening tenants, managing lease agreements, collecting rent, and coordinating maintenance.
Three Palms Rental Management offers property management services designed to streamline the rental process for property owners. Our Services include marketing properties, screening potential tenants, managing lease agreements, collecting rent, and coordinating maintenance.
The Site itself provides information about our services, contact and inquiry forms, and the ability to request a free rental analysis. Where tenant or owner portal features are made available, they are provided through third-party property management software and are subject to those providers’ terms.
The specific features and functionalities available on the Site may change over time. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. Any new features added to the Services will also be subject to these Terms, and your continued use of the Site after such changes constitutes acceptance of the updated Terms.
You do not need to create an account to browse the Site or submit an inquiry. Certain tenant or owner portal features, where offered, are provided through third-party property management software; access to those portals is governed by the applicable provider’s terms and your separate agreement with us.
You must be at least 18 years old to use our Services or submit information through the Site. You agree to provide accurate, current, and complete information when you contact us or submit a request, as inaccurate information can cause problems with your inquiry. If you are provided access to any portal, you are responsible for maintaining the confidentiality of your credentials and for activities that occur under your access, and you agree to notify us immediately of any unauthorized use.
The Site does not process payments and does not collect or store your payment card details. Any rent payments, application fees, or other transactions are handled outside the Site through third-party portals or payment processors made available to tenants and owners, subject to those providers’ terms of service and privacy policies.
Any questions or disputes regarding payments should first be directed to Three Palms Rental Management, and we will assist you or refer you to the appropriate provider. You understand that we are not responsible for errors or issues caused by third-party payment processors.
The Site and its entire contents, features, and functionality (including all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by Three Palms Rental Management, its licensors, or other providers of such material, and are protected by United States and international intellectual property laws.
These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on our Site, except as generally permitted by the Site’s functionality. The Site and Services are provided on an “as is” and “as available” basis. Three Palms Rental Management makes no representations or warranties of any kind, express or implied, as to the operation of the Site or its content. You expressly agree that your use of the Site is at your sole risk.
We do not warrant that the Site will be uninterrupted or error-free, and we do not guarantee the accuracy, completeness, or usefulness of any information on the Site. To the fullest extent permitted by applicable law, Three Palms Rental Management and its affiliates, officers, directors, employees, agents, suppliers, or licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the Site or Services. Our total liability for any damages arising out of or related to these Terms or your use of the Site or Services will not exceed the greater of one hundred U.S. dollars ($100) or the amount you have paid to Three Palms Rental Management in the past twelve months, if any.
You agree to defend, indemnify, and hold harmless Three Palms Rental Management, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, and assigns from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site or Services.
These Terms and your use of the Site and Services are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site or Services shall be instituted exclusively in the state or federal courts located in San Diego County, California, and you waive any objections to the exercise of jurisdiction and venue in such courts. We encourage you to contact us directly to seek a resolution before pursuing any legal action.
We may terminate or suspend your access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason, including a breach of these Terms. If you wish to stop using the Services, you may simply discontinue use or contact us. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to the new terms taking effect.
